The first reason is to make sure you will be in control.

 

In the event you are not able to directly do so, you still want to be in control and in charge of all the health care decisions affecting you, including who you decide will be responsible for voicing those decisions. Making your medical wishes known now, before there is a need for them, is essential in maintaining your autonomy.

The second reason for the Health Care Directives is that they will provide peace of mind for your loved ones.

 

Without a plan in place expressing your wishes, your family and doctors are left without direction; they are left to guess the type of care or life-sustaining treatment you would want.

By now you know the reasons for having these documents in place long before you need them, so that if you do need them – you can remain in control and provide peace of mind for your loved ones!


The Power of Attorney, document is intended to cover your financial matters.


That is, in the event you are unable to make your own decisions while still living, how would your financial life continue?

  •     Who would be able to use your money to pay your mortgage and other bills?
  •     Who would manage your investments and file your taxes? 

 

Whether your incapacitation occurs because of an accident, illness or simply from the effects of aging, a Property Power of Attorney will allow you to select someone you trust to look out for your financial wellbeing and act in your best interest.

 

So, when deciding who you want to designate as your Agent, it is important that you fully trust them, and that this person (or persons) will do what you would want, not what they would want.


For example, if you have pets and caring for them is important to you, will your agent use your funds for the proper care of your pets, or will spending your money on your pets seem like a frivolous and wasteful thing to do with your money? Someone else’s intentions may be good, but may not be in line with what you would want.


And lastly, make sure that the agent you are appointing has the ability to carry your decisions thru. This does not mean that they have to handle the matters themselves; but it does mean that they will have the ability to ensure the matters are handled. For example, if your taxes need to be filed, will they have the ability to hire a qualified tax preparer?


Selecting the right people to handle your financial affairs is critical – which is why you should do it thoughtfully. The alternative could very well be that a court will appoint your Agent, and then supervise and oversee your affairs. This would be a very expensive and inefficient way for your affairs to be managed, and you certainly would not want that!!
